False Case of grievous hurt and criminal trespass: Sunil Kumar Bansal & his brother acquitted after 14 years

During 2005, a number of media houses reported the illegal operations of touts and travel agencies around the Ritz Cinema of Kashmere Gate ISBT area. Two people namely Sunil Kumar Bansal and his brother Praveen Kumar Bansal tipped the news to reporters about the unauthorized business that was going on in a full swing.

In a bid to take revenge, Rasheed Baig, the owner of Alok Travels and the kingpin of this unauthorized travel trade who had several cases registered against him filed a false FIR at Kashmere Gate Police Station of grievous hurt and criminal trespass against the two brothers. As a result, the two brothers were forced to defend themselves for over 14 years against the crime they didn’t commit. 

On 24.12.2021, the Learned Metropolitan Magistrate Kapil Kumar at the Tis Hazari court has acquitted both of these two accused of all charges made against them in the FIR. The court observed that the knowledge of law was misused to implicate the accused persons in this case.

Advocates Navit Bansal and Deepak Gaur contested the case on the behalf of the accused brothers and their strong arguments brought justice to the long-pending case.

“This is a victory of truth as the Court has rightly acquitted the accused persons because the entire FIR was false. They further said that the orders passed by the court are extremely Bold and Clear wherein the court has clearly observed how one brother who was a declared Bad Character of the area and the other brother who was an employee of Tis Hazari Court, misused their knowledge of the law to falsely implicate the accused persons.” Said Advocate, Deepak Gaur.

The court’s order specifically states “this court likes to highlight a fact which is though not very relevant but certainly worth mentioning which could reflect upon the manner of things moved in a particular way in the present case. The complainant was in the records of bad character of the area as he was having several cases registered against him. This fact was affirmed by the IO and the documents on that aspect were filed in the defense evidence which are available on record. The brother of the complainant namely Mirza Zahid Beg was posted as Reader in the court of Ld. ASJ Tis Hazari at the relevant time. Both the brothers were aware of the fine lines of criminal law and the consequences which follow when the opinion of doctor on the natures of injuries changed from ‘simple’ to ‘grievous. Both the persons were in the system of criminal administration, one person from being the accused in many cases and the other person from being posted in a criminal jurisdiction court.” 

Heaving a sigh of relief with the court’s order, the accused persons stated that the order has once again shown how justice still prevails in our country and why everyone believes in the constitution.
